Does New York have a “certification of trust” statute?
Not the way Uniform Trust Code states do. New York hasn’t adopted the UTC and has no single statute that prescribes a certification-of-trust form or a required-elements list. In practice, New York banks, title companies, and brokerages accept a properly executed Certification of Trust (also called an Affidavit of Trust, Trust Abstract, or Memorandum of Trust) in lieu of the full trust instrument. This template gives them the standard terms they ask for, executed with the correct New York acknowledgment.
Is this a Certificate of Trust, an Affidavit of Trust, or a Memorandum of Trust?
It can serve as all three. Why does funding (EPTL § 7-1.18) matter?
Under EPTL § 7-1.18, a New York lifetime trust is valid only as to assets actually transferred into it — recording a deed or completing registration in the name of the trust or trustee. A recital in the trust document is not enough. The Certification of Trust is the document you hand a bank or title company to retitle accounts and property into the trust’s name.
Does the trustee have to sign in front of a notary?
