How long is a Montana notary commission, and what does it take?

A Montana notary commission is 4 years. You must obtain a $25,000 surety bond (or its functional equivalent — one of the country’s highest), complete the SOS notary education course, apply online through the SOS, and take the oath of office. Adjoining-state residents (ID/ND/SD/WY) may qualify with Montana employment.

What must a Montana notary stamp include?

Under MCA 1-5-616, your stamp must show your name as commissioned, the words ‘Notary Public,’ ‘State of Montana,’ and your commission expiration date. It must be capable of being copied with the record.

Does Montana require a notary journal?

Yes. Montana requires a journal of every notarial act under MCA 1-5-618. For RON acts, retain the audio-visual recording in addition to the journal entry.

What can a Montana notary charge per act?

Montana caps fees at $10 per traditional notarial act and $25 per remote (RON) act. Travel may be agreed separately.

Does Montana allow Remote Online Notarization (RON)?

Yes. Montana authorizes RON under RULONA. You must hold an active commission, register with the SOS, use a state-approved technology vendor that provides identity-proofing and credential analysis, keep the required electronic journal, and retain the AV recording. You must be physically located in Montana when you perform the remote act.
