About the Enhanced New Mexico Notary Handbook

New Mexico adopted RULONA in 2021 (NMSA 14-14A-1 through 14-14A-32). The framework requires a state-approved education course + exam for new notaries, a $10,000 bond, a required stamp and journal, and a $5 per-act fee cap (with a separate RON technology surcharge up to $25). How long is a New Mexico notary commission, and what does it take?

A NM notary commission is 4 years. New applicants must complete an SOS-approved education course and pass a proctored exam, obtain a $10,000 surety bond (the bond form must be notarized by another NM notary), apply through the SOS for a $30 fee, and take the oath of office. Adding RON authorization is an additional $75.

What must a New Mexico notary stamp include?

Your stamp must show your name as commissioned, the words ‘Notary Public,’ ‘State of New Mexico,’ and your commission expiration date. It must be capable of being copied with the record.

What can a New Mexico notary charge per act?

NM caps notarial-act fees at $5 per acknowledgment, jurat, or oath. Copy certifications are 50¢ per page with a $5 minimum. RON adds a TECHNOLOGY SURCHARGE of up to $25 per act on top of the $5 notarial fee. Travel may be agreed separately and disclosed in advance.

Does New Mexico allow Remote Online Notarization (RON)?

Yes. NM authorizes RON under RULONA. You must hold an active commission, complete additional RON training, pay the $75 RON authorization fee, use an approved technology vendor, keep the required electronic journal, and retain the audio-visual recording. You must be physically located in New Mexico when you perform the remote act.
