About the Enhanced Louisiana Notary Handbook

Louisiana’s notary office isn’t like any other state’s. How long is a Louisiana notary commission, and what does it take to get one?

A Louisiana notary commission is for LIFE — the longest term in the country. To earn it you must be 18+, a Louisiana resident registered to vote in the parish where you will be commissioned, have a high school diploma, have no unpardoned felony convictions, pass the state-administered notary EXAM under La. R.S. 35:191 (active Louisiana-licensed attorneys are exempt), obtain the required surety bond, file two oaths (SOS + parish Clerk of Court), and pay the $35 SOS filing fee.

What is the new Louisiana notary bond amount?

Under Act 258 of 2025, the surety bond required of non-attorney notaries jumps from $10,000 to $50,000 effective February 1, 2026. The bond must be renewed every 5 years. E&O insurance is highly recommended on top of the bond.

Does Louisiana require a notary stamp?

No. Louisiana is the only state where the notary’s SIGNATURE is the seal (La. R.S. 35:12) — no stamp is required by statute for paper notarizations. That said, most lenders, title companies, and out-of-state recipients expect a stamp, so using one (with your name, “Notary Public,” “State of Louisiana,” your parish, and your notary ID number) is best practice.

What can a Louisiana notary do that notaries in other states can’t?

Louisiana follows the civil-law tradition, so non-attorney notaries hold a much broader office. You can DRAFT authentic acts and acts under private signature — sales of immovable property, donations inter vivos, matrimonial agreements, powers of attorney, successions support, and more — that in other states are reserved to attorneys. Louisiana also does not impose a statutory fee schedule on non-attorney notaries; you may charge a reasonable, disclosed fee for each act and your drafting time.

Does Louisiana allow Remote Online Notarization (RON)?

Yes — Louisiana authorized RON effective February 1, 2022 (La. R.S. 35:621 et seq.). You must register with the Secretary of State, complete required training, use an approved tamper-evident technology platform with identity proofing, and retain electronic copies plus the audio-visual recording of each session for at least 10 years. RON CANNOT be used for testaments or codicils, trust instruments or their acknowledgments, donations inter vivos, matrimonial agreements or their acknowledgments, or acts modifying/waiving/extinguishing final spousal support — those still require in-person appearance.
