About the Enhanced Ohio Notary Handbook

Ohio’s notary law (ORC Chapter 147) was modernized effective September 20, 2019. Non-attorney notaries serve 5-year terms; Ohio attorneys hold indefinite commissions while in good standing. New non-attorney applicants must complete a 3-hour SOS-approved course and pass an exam. There is NO bond required for standard commissions (but a $25,000 surety bond AND $25,000 E&O are required if you want to notarize electronic estate-planning documents). Every notary must keep a journal. Fees are $5 per traditional act and up to $30 RON + $10 technology fee.

How long is an Ohio notary commission, and what does it take?

Ohio non-attorney commissions are 5 years. Ohio attorneys in good standing hold indefinite commissions. New non-attorney applicants must complete a 3-hour SOS-approved course and pass an exam, pass a BCI background check, and apply online with the SOS (fee up to $150 new, $60 renewal). There is NO bond required for a standard commission — but a $25,000 surety bond AND $25,000 E&O are required to notarize electronic estate-planning documents.

What must an Ohio notary stamp include?

Your stamp must be circular, ¾ to 1 inch in diameter, with a serrated or milled edge, and include the words ‘Notary Public,’ ‘State of Ohio,’ your name as commissioned, and a facsimile of the Great Seal of Ohio (the coat of arms).

Does Ohio require a notary journal?

Yes. Since the 2019 modernization, Ohio requires a journal of every notarial act (paper or electronic). For RON acts the journal is electronic and the AV recording must be retained per current SOS rules.

What can an Ohio notary charge per act?

Ohio caps traditional notarial fees at $5 per act. Remote Online Notarial Acts (RON) are up to $30 per act PLUS an optional technology fee of up to $10 — for a maximum total of $40 per RON act. Travel may be agreed separately and disclosed in advance.

Does Ohio allow Remote Online Notarization (RON)?

Yes. Ohio authorizes RON through SOS-approved technology providers. You must hold an active Ohio commission, complete RON-specific training, register with the SOS and an approved provider, use the provider’s tamper-evident technology with identity-proofing and AV recording, and keep the required electronic journal. You must be physically located in Ohio when you perform the remote act.
