About the Enhanced South Carolina Notary Handbook

South Carolina’s notary law lives in S.C. Code Title 26, Chapter 1. SC notaries are appointed by the GOVERNOR (commission issued through the Secretary of State) for a TEN-YEAR term — the LONGEST term in the country. NO bond is required, the application fee is $25, and an ink stamp is required showing ‘Notary Public’ and ‘State of South Carolina.’ A journal is not required by law but strongly recommended. SC does NOT currently authorize full Remote Online Notarization — only In-Person Electronic Notarization (IPEN), where the signer must be physically present.

Is this the official South Carolina notary handbook?

No. This is an independently produced, enhanced study and reference guide. It is not the official South Carolina Notary Public Reference Manual and is not affiliated with or endorsed by the State of South Carolina, the Governor, or the South Carolina Secretary of State.

How long is a South Carolina notary commission?

A SC notary commission is TEN YEARS — the longest term in the country. Notaries are appointed by the Governor and the commission is issued through the Secretary of State.

Does South Carolina require a stamp, a bond, or a journal?

An ink stamp or seal showing your name, ‘Notary Public,’ and ‘State of South Carolina’ is REQUIRED on every paper act. There is NO bond required. A journal is not required by law but is strongly recommended by the SOS.

Does South Carolina allow Remote Online Notarization (RON)?

Not full RON. SC currently authorizes only IN-PERSON ELECTRONIC NOTARIZATION (IPEN), where the signer must be physically present with the notary even though the document is signed and notarized electronically. Do not perform full RON for an SC-jurisdiction act; watch sos.sc.gov for any changes.

What can a South Carolina notary charge per act?

If you charge fees, SC requires you to POST a fee schedule conspicuously in your place of business. Travel may be charged when agreed in advance and disclosed. Disclose all fees upfront.
